Terms of Service

This agreement ("Agreement") is entered into by and between you ("User" or "Developer") and Alting AI ("Company", "We", "Us", or "Our"). By using any of our services, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to these terms, you may not use our services.

1. Services

Alting AI is an AI model aggregator, providing a unified easy-to-use platform for everyone to access and use AI models and tools ("Services"). Additionally, we provide a developer API for integrating Alting AI into your own applications ("API"). Applications built using the API are subject to the same terms and conditions as our Services. We reserve the right to display applications built using the API on our website and in our marketing materials.

Alting AI is in early access, and we may change or discontinue any part of the Services or API at any time. We may also impose limits on certain features or restrict access to parts of the Services or API.

We may add, modify, or remove features and models from the Services or API at any time. When a model is removed, we will provide at least 30 days' notice before discontinuing the model, if you have used the model in the past 30 days. Additionally, we may re-route your requests to a similar model if available for a 2-week period after discontinuation.

2. Users and Developers

For the purpose of this Agreement, "Users" are individuals who interact with the Services through our website or applications. "Developers" are individuals or organizations who build applications using our APIs.

3. Obligations

Use of Alting AI by anyone under the age of 13 is prohibited. You represent and warrant that you are at least 13 years of age and have the legal capacity to enter into this Agreement. If you are under the age of 13, you may not use the Services or API without parental consent. Models accessed via Alting AI may produce content that is not suitable for minors. If you are accepting these terms on behalf of someone else or an organization, you represent and warrant that you have the authority to bind that person or organization to these terms.

You agree not to use Alting AI to:

• Violate the law or infringe on the rights of others
• Violate any terms of these terms or any other agreement with us, or policies of third-party providers that power the models we provide access to.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any model, algorithm, or system we provide access to.
• Abuse, harm, interfere with, reverse engineer, or disrupt the Services, API, the models, or their underlying technologies, such as accessing or using them in a fraudulent or deceptive ways, introducing malicious code, or spamming, hacking, or bypassing security measures.
• Use Alting AI or the models in a prohibited manner, such as for illegal, harmful, or offensive purposes, or in a way that violates the rights of others, including intellectual property rights, privacy rights, or other proprietary rights, or by exceeding usage limits or quotas, or by creating or using multiple accounts to circumvent usage limits or quotas.
• Use any method to extract data from Alting AI, including but not limited to scraping, web harvesting, or using any automated means to access the Services or API, without our express written consent.
• Represent that Alting AI-generated content is human-generated.

4. Payment

Developers need to purchase credits to access the API. Credits are non-refundable and non-transferable. We may change the price of credits at any time. We may also offer free credits to Developers for testing purposes or as part of promotions. We may also offer discounts or promotions on credits from time to time.

Users can access the Services for free with daily usage limits. We may change the daily usage limits at any time. Users can also purchase paid monthly or annual plans to access additional features and incease usage limits. We may change the price of paid plans at any time. We may also offer discounts or promotions on paid plans from time to time.

Alting AI uses Stripe to securely process payments. By using our Services, you agree to be bound by Stripe's Terms of Service.

In the event that we receive a fraud dispute on a payment, we reserve the right to suspend or terminate your account and access to the Services or API.

We may change our pricing at any tim. If we do, we will provide at least 30 days' notice before the changes take effect. If you do not agree to the changes, you may cancel your account before the changes take effect.

5. Intellectual Property Rights

By using our Services, no intellectual property rights are transferred to the User or Developer. All rights, titles, and interests in and to the Services, including any software, technology or processes, belong to Alting AI. You may not use our Services in any way that infringes on our intellectual property rights.

All material that you upload, publish, or display within Alting AI, and any results that you receive in response to your prompts (or other inputs) from models accessible on our platform ("Model-Generated Content"), will collectively be considered "Your Content." You retain all rights to Your Content.

6. Dispute Resolution

Any disputes arising out of or relating to these Terms of Service, or your relationship with Alting AI under these Terms of Service, shall be resolved by binding arbitration. This Agreement is governed by the laws of the Kingdom of Denmark, without regard to its conflict of law principles.

7. Privacy Policy

Our Privacy Policy describes how we collect, use, and disclose your information when you use our website or Services. By using our website or Services, you agree to the terms of our Privacy Policy. You can read our Privacy Policy here.

8. Liability

To the extent permitted by law, Alting AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from the use of our Services or API.

9. Modifications

We may update this Agreement from time to time without prior notice. We will post the updated Agreement on our website with the "Last Updated" date at the top of the page. We encourage you to review this Agreement periodically for any changes. Your continued use of our Services or API after the changes have been made will constitute your acceptance of the updated Agreement.

10. Termination

We reserve the right to terminate or suspend your account at any time without prior notice for any reason. If your account is terminated, you will lose access to our Services and API. Upon termination, all rights and obligations of the parties under this Agreement will be extinguished, except for those rights and obligations that by their nature should survive termination, including but not limited to the rights of the parties to use or disclose information that was obtained before termination.
